Terms of Use

CapyCore Games Studio ("CapyCore," "we," "us," or "our") is a studio project of Mission Street Collaborative LLC, an Alabama limited liability company, operating under the trade name CapyCore Games Studio. Mission Street Collaborative LLC is the contracting party under these terms.

By downloading, installing, or playing a CapyCore game, or by using capycore.games (together, the "Services"), you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the Services.

If you are under the age of majority where you live, you may use the Services only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these terms on your behalf.

Subject to these terms, CapyCore grants you a limited, personal, non-exclusive, non-transferable, revocable license to download and use our games on Apple devices you own or control, for your own non-commercial entertainment. All rights not expressly granted are reserved.

You agree not to:

• copy, sell, rent, sublicense, or redistribute our games or website content;
• reverse engineer, decompile, disassemble, or attempt to derive source code, except where that restriction is prohibited by law;
• modify, cheat, tamper with, or create derivative works from our games, or circumvent any technical protection;
• use bots, scrapers, or automated means to access the Services, or interfere with their security, availability, or integrity;
• use the Services for any unlawful purpose or in violation of any applicable law.

Our games are distributed through the Apple App Store and your use is also subject to Apple's Licensed Application End User License Agreement and App Store Terms of Service. You acknowledge and agree that:

• these terms are between you and CapyCore only, not with Apple, and Apple is not responsible for our games or their content;
• Apple has no obligation to furnish any maintenance or support for our games;
• in the event a game fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever;
• CapyCore, not Apple, is responsible for addressing any claims relating to a game, including product liability, legal or regulatory compliance, and consumer protection claims;
• CapyCore, not Apple, is responsible for investigating and resolving any third-party intellectual property infringement claim relating to a game;
• you represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list;
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Any paid games or in-app purchases are processed by Apple, not by CapyCore. Pricing, billing, and refunds are governed by Apple's terms and handled through your Apple Account. We cannot issue refunds directly, but we're happy to help you troubleshoot a problem through our contact form.

If you subscribe to studio updates, you consent to receive email about new games, betas, and studio news. You can unsubscribe at any time using the link in any email. We do not sell or share your email address; see our Privacy Policy.

We love hearing ideas. If you send us feedback, suggestions, bug reports, or game ideas, you grant CapyCore a perpetual, irrevocable, worldwide, royalty-free license to use them in our games and business without obligation, compensation, or attribution to you. Please don't send us anything you consider confidential or that you don't have the right to share.

The Services, including our games, artwork, characters (including Flapybara), logos, names, audio, code, and website content, are owned by CapyCore Games Studio or its licensors and are protected by copyright, trademark, and other laws. "CapyCore," "CapyCore Games Studio," and our game titles and logos are our trademarks. You may not use them without our prior written permission, except for fair uses such as reviews, news reporting, and gameplay videos that do not imply our endorsement.

We are a small studio. We may add, change, suspend, or discontinue any part of the Services, including individual games or features, at any time and without liability. We may also update these terms; material changes take effect when we post the revised terms and update the "Last updated" date above. Continuing to use the Services after that means you accept the changes.

To the fullest extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components, or that any defect will be corrected. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

To the fullest extent permitted by law, Mission Street Collaborative LLC (d/b/a CapyCore Games Studio) and its members, owners, family members, and contributors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or device damage, arising out of or relating to your use of the Services, even if we have been advised of the possibility of such damages.

Our total aggregate liability for all claims relating to the Services will not exceed the greater of (a) the amount you paid us for the game or feature giving rise to the claim in the twelve months before the claim, or (b) twenty-five U.S. dollars (US$25).

You agree to indemnify and hold harmless CapyCore Games Studio from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Services or your violation of these terms or applicable law.

These terms apply until terminated. Your license ends automatically if you violate them, and you may end it at any time by deleting our games and stopping use of our website. Sections on intellectual property, feedback, disclaimers, liability, indemnification, and governing law survive termination.

These terms are governed by the laws of the State of Alabama, United States, without regard to its conflict-of-laws rules. You and CapyCore agree to the exclusive jurisdiction of the state and federal courts located in Madison County, Alabama, for any dispute not subject to another agreed process. Nothing here deprives you of any mandatory consumer protections or the right to bring a claim in your local courts where applicable law grants that right.

These terms, together with our Privacy Policy, are the entire agreement between you and CapyCore regarding the Services. If any provision is found unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of assets.
